Terms and Conditions

1. About these terms

These terms apply when you subscribe to Pocket Site, our subscription website service for therapists. Please read them carefully. By signing up for a subscription, you agree to these terms, including the Data Processing Agreement in section 7.

Pocket Site is run by Sophie Wood, trading as Buzz Web Consultancy and Pocket Site (“we”, “us” or “our”).

  • Address: 24 Altrincham Road, Wilmslow, Cheshire SK9 5ND
  • Email: sophie@buzzwebconsultancy.co.uk
  • Website: https://pocketsite.co.uk

“You” means the therapist or practice that subscribes to Pocket Site. Pocket Site is a service for businesses, so these terms are a business-to-business agreement.

2. The service and your subscription

What we provide. Pocket Site provides a website for your therapy practice, built on our platform, together with hosting, security updates, backups and the features included in your chosen plan, as described at https://pocketsite.co.uk/#prices.

Billing. Subscriptions are billed in advance, monthly or annually depending on the plan you choose. Your subscription renews automatically at the end of each billing period unless you or we cancel it.

Payment. You need a valid payment method, such as a debit or credit card or PayPal. Payments are handled by our payment provider; we do not see or store your full card details. You must give us accurate billing details and keep them up to date. If a payment fails, we will send you an invoice to pay by the date shown. If it is not paid, we may suspend your website until it is.

Fee changes. We may change our subscription fees. We will give you at least 30 days’ notice before a change takes effect, and it will apply from your next billing period. If you do not want to pay the new fee, you can cancel before it takes effect.

Refunds. Subscription fees are not usually refundable. We may consider refund requests case by case.

Your account. You must keep your login details secure and not share them. Tell us straight away if you think someone else has accessed your account.

3. Your content and responsibilities

Your content. You are responsible for the text, images, videos and other material you add to your website, or ask us to add (“your content”). This includes making sure it is accurate, lawful and in line with your professional body’s guidance.

You confirm that you own your content or have permission to use it, and that it does not break anyone else’s rights, including copyright and privacy.

You keep all rights in your content. You give us permission to host, copy, adapt and display it only as needed to provide the service.

Your legal responsibilities. As the person responsible for your practice, you must:

  • have a privacy policy and cookie policy on your website that are accurate and up to date
  • tell visitors that enquiries sent through your website are stored on the website and deleted after six months
  • keep your own copy of any enquiry you need to keep for longer, for example in your email or records system
  • register with the Information Commission and pay the data protection fee, if you are required to

Acceptable use. You must not use your website for anything unlawful, misleading or harmful, or that could damage our platform or other subscribers’ websites.

Our platform. The Pocket Site platform, themes, templates, designs and code remain our property or our licensors’. While your subscription is active, you have a licence to use them for your website. You may not copy them or use them elsewhere without our written permission.

Credit link. While your subscription is active, we have the right to include a credit link on your website, such as “Designed by Pocket Site” in the footer, linking to https://pocketsite.co.uk. Please do not remove or change it.

Showing your website in our portfolio. While your subscription is active, we have the right to show your live website in our portfolio and marketing, including your practice name, a link to your website and screenshots of it. We will never show enquiries, client information or anything else that is not already public on your website.

When your subscription ends, we will remove your website from our portfolio within 30 days.

Your domain name. You own your domain name. When your subscription ends, you keep it and can use it with another website.

5. Cancelling and ending your subscription

Cancelling. You can cancel at any time through your account or by emailing sophie@buzzwebconsultancy.co.uk. Your website stays live until the end of the billing period you have paid for.

If we end or suspend your subscription. We may suspend or end your subscription if you do not pay, or if you seriously break these terms. Where we can, we will tell you first and give you a chance to put things right. We may also end the service for any reason by giving you at least 30 days’ notice.

What happens at the end. When your subscription ends, your website is taken offline. Before then, you can ask us for a copy of your content and contact form entries. We will delete your website and the personal data on it as set out in section 7.

6. Liability and general terms

Our service. We take reasonable care to keep your website secure and available, but we cannot promise it will always be uninterrupted or error-free.

Limit on our liability. We are not liable for indirect or consequential losses, such as loss of profit, business or goodwill. Our total liability to you in any 12-month period is limited to the subscription fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

Your responsibility. You are responsible for any claims arising from your content or from you breaking these terms.

Third-party links. We are not responsible for third-party websites or services linked from your website or ours.

Changes to these terms. We may update these terms. We will give you at least 30 days’ notice of any significant change. If you do not agree, you can cancel before the change takes effect.

Privacy and cookies. Our privacy policy and cookie policy explain how we use personal data about you as a customer.

General. If any part of these terms is found to be invalid, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These terms, including the Data Processing Agreement, are the whole agreement between us about the service.

Law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

7. Data Processing Agreement

This Data Processing Agreement (DPA) forms part of these terms and meets the requirements of Article 28 of the UK GDPR. It applies to personal data on your website that we process on your behalf.

Our roles. You are the controller of the personal data on your website. We are your processor, and we only process that data to provide the Pocket Site service.

Details of the processing

How long for For as long as your subscription is active, and until the data is deleted under this DPA
Whose data Visitors to your website and people who contact you through it
Types of data Names, contact details, messages, IP addresses and technical data. Messages may include health information, which is special category data

What we will do

  • Process the data only on your documented instructions, which are these terms and how you set up and use your website. If we think an instruction breaks data protection law, we will tell you.
  • Make sure anyone who can access the data keeps it confidential.
  • Keep the data secure, including SSL, regular software and security updates, firewall and malware protection, secure backups, and access limited to people who need it, using strong passwords and two-factor authentication.
  • Help you respond to requests from people using their data protection rights, such as finding or deleting an enquiry.
  • Help you meet your obligations on security, breaches and data protection impact assessments, as far as is reasonable for our role.
  • Give you the information you need to show you are complying with this DPA, and allow reasonable audits on reasonable notice.

Contact form enquiries. Copies of contact form enquiries stored on your website are automatically deleted after six months. Copies held in our backups are deleted within a further month, when those backups expire. Enquiries are also sent to your email, and you are responsible for any copies you keep there or elsewhere.

Sub-processors. You agree that we can use the following types of sub-processor to provide the service:

  • our website hosting provider
  • our backup storage provider
  • our email delivery provider, which sends contact form enquiries to you

We will tell you who they are if you ask.

We have written contracts with our sub-processors that give the same level of protection as this DPA. We will give you at least 30 days’ notice before adding or replacing a sub-processor. If you object on reasonable data protection grounds, you can cancel your subscription before the change takes effect.

International transfers. If a sub-processor is based outside the UK, we will make sure the data is protected by a UK adequacy decision, the UK Extension to the EU-US Data Privacy Framework, or the International Data Transfer Agreement or UK Addendum.

Your responsibilities as controller. You are responsible for having a lawful basis for collecting personal data through your website, and for telling visitors how it is used in your privacy policy. This includes that enquiries are stored on the website and deleted after six months.
